Power of eSignatures extended with COVID-19 Legislation
The COVID-19 Legislation Amendment (Emergency Measures) Act 2020 (New South Wales/NSW) was passed on 25 March 2020 and enables “altered arrangements for witnessing signatures, including requirements for certification of certain matters by witnesses and verification of identity, provided for by an Act or another law”.
This has been adopted by legislation as schedule 1 of the Electronic Transactions Act of 2000 (NSW), stating that all documents may be signed electronically if the original signature is faxed to the court, or if it is authenticated in another way that is in line with the rules of the Court.
In addition, the electronic signing of documents will be accepted in all Federal Courts. This includes, but is not limited to, documents such as affidavits (as per the Practice Note update on 31 March 2020).
The Law Institute of Victoria also published guidelines on witnessing documents electronically, as well as verification of identity during the COVID-19 period. These guidelines are in line with the Legislation Amendment Act 2020 (NSW) and are being considered in Victoria.
